My Passion For Palliative And Hospice Care Social Work

When it came to envisioning my advanced block placement, I knew I wanted something different, something to transform the way I practiced social work for the last fourteen years. The timing ideal as my passion for palliative and hospice care social work was in transition. I seized the opportunity in preserving it by securing an international internship where I could research the cultural differences in the quality of both the tangible and intangible deliverables in providing compassionate end-of-life care. The destination, Nepal! Knowing I was traveling to an underdeveloped nation, I did my homework, or did I? I partnered with an ancillary community college who I thought focused on expanding the development of social work as a discipline in Nepal and were teaching BSW students to become nearly the first truly ‘educated’ social work practitioners in the country, which excited me. Disappointingly, the system lacked structure and organization. My trip started off tumultuously, as did my relationship with my host, consequentially who lacked hospitality among other qualities, leaving me to discover the copious cultural dichotomies and challenges around every corner, alone, daunted by the lack of local support. He’s always going to be the irresponsible young man who asked Tranio and CALLIDAMATES to talked to his father because he was scared to get punished by his father. At the end of the scene, Plautus had the characters returned to their status quo. To maintain the status quo is to keep the things the way they presently are. After all the tragedy that happened, at the end of the scene everyone went back to normal. In the beginning of the scene it talks about the identity of the characters and that no matter what the situation was, the character would still maintain their own identity. The phase Identity is destiny and status quos demonstrate that no matter what the character did in the play, their personality and their role will remain the same. The amendments brought forth in the Work choices Act were criticized as being against the interests of the employees and workers and in favour of the employers and businesses (Riley, 2010). There was a lot of debate about the constitutionality of the Work Choices Act and it was alleged that the provisions of the Work Choices act were contrary to the Constitution of Commonwealth of Australia. The reason why this submission is being made is because the constitutional basis for the Fair Work Act, 2009 (Chapman, 2009) is same as that of Fair Choices Act, 2005.To develop a better understanding of the constitutional basis of the Fair Work Act, 2009, it is important to discuss the landmark case of New South Wales vs Commonwealth1 wherein the constitutionality of the Work Choices Act 2005 was discussed and adjudicated upon by the Honble High court of Australia. The basic point of contention in the instant case was the expansion of federal powers regarding the labour welfare legislation in the form of Work Choices Act, 2005. The major point of contention was the purported elimination of the State Territory jurisdiction to legislate upon the labour welfare legislation and such powers were to be shifted to the federal parliament. Various states of the Commonwealth of Australia and major trade unions of the Commonwealth of Australia were parties to the aforementioned case in which the major points of contention stated above were debated and adjudicated upon (Lucev, 2009). The Commonwealth of Australia contended that the Commonwealth and federal parliament was well within its powers as per the Constitution of commonwealth of Australia. The Governments thrust was in the argument that it was well within its powers to legislate upon any topic or law which created, altered the provisions pertaining to the conduct of employees of corporations, laws pertaining to business functions and various corporations activities and relationships. The Government is also empowered to legislate upon issues protecting the corporations from various kinds of loss or damage. These powers are derived from (WASF, 2009)Section 51 (xx) of the Commonwealth of Australia constitution Act2. The provisions of the aforementioned section of the Constitution of Australia are often known as Corporation Powers and they bestow upon the Commonwealth and Federal parliament to legislate upon topics pertaining to foreign corporations, trading and financial corporations and this contention of th e Commonwealth of Australia was upheld by the Honble High Court of the Commonwealth of Australia vide a majority judgement in favour of the commonwealth government. Accordingly, it can be stated that the constitutional basis of the Fair Work Act, 2009 is section 51 (xx) (WASF, 2009) of the Commonwealth of Australia Constitution. In this regard, it is pertinent to note that there has been a significant change in the fair Work Act, 2009 when compared to the earlier labour welfare legislations in place in the Commonwealth of Australia, as earlier common law contracts pertaining to labour contracts were allowed in the commonwealth of Australia. With advent of the Fair Work Act, 2009 even though common law contracts are allowed, the same are abolished in case of individual statutory contracts. Even in cases wherein the common law contracts are allowed, the terms and conditions offered in the common law contracts cannot be less beneficial than the terms and conditions that are guaranteed under the National Employment Standards. The National Employment Standards as per the Fair Work Act, 2009 establish a minimum or basic safety net for welfare of the workers and employees so that the employees are guaranteed the minimum set of safeguards and in this regard, the Fair Work Act, 2009 has been remarkable. The most remarkable feature of this statute has been the scope of the statute because it applies to the Constitutional Corporations and these corporations are covered under section 51 (xx) of the Commonwealth Constitution. Another important feature of Fair Work Act, 2009 is the National Employment Standards and they set the minimum standards of employment which would govern the employment conditions in the Constitutional Corporations. The NATIONAL Employment Standards along with the Modern Awards established by the Fair Work Act, 2009 set up the basic safety net for the workers working in the Constitutional Corporations. (LSCSA)The various areas which are covered under the National Employment Standards are, maximum number of working hours, provisions for parental leave, arrangements for flexible working hours and options related to the same, various types of holidays such as annual leave, public holidays, community service and long leave entitlements compassionate leave entitlements termination and redundancy entitlements etc (Pickering, 2010). it is because of the National Employment Standards that even if the common law contract governing employment in a Constitutional Corporation, notwithstanding th e provisions to the contrary to the National Employment Standards in the common law contract, the provisions of the National Employment Standards and the Modern Award would prevail over the latter. It is submitted that the Fair work Act, 2009 is remarkable in a lot of ways and it plays a very significant role in bringing uniformity in the labour welfare legislation in the sense that it not only brings uniformity across the states pertaining to employment contracts and conditions, it also provides a platform for collective bargaining between the employees and the employers thus, it would not be wrong to state that the Act attempts to create a balance between the interests of the employees and the employers, i.e. businesses. What is the difference between agency employment and temporary transfer of employment where a third party is injured? Explain with reference to case law and relevant legislation Agency work (Johnstone Quinlan, 2005) often comes across as a way in which certain principal employers attempt to circumvent the arms of Law to evade or at least complicate the manner in which Occupational Health and safety Laws and their application can be avoided. The reason behind this is because the principal employer outsources the job for which the contracting agency hires the workers who undertake the tasks which are required to be fulfilled by the Principal employer. In this regard, what is noteworthy is that even though the workers are undertaking the tasks belonging to the host employers, it is for the temporary basis and notwithstanding the fact that the risks posed by the tasks and the working environment which are totally the responsibility of the host employer, can be circumvented owing to the indirect relationship with the workers because of the triangular relationship between the host employer and the actual workers. The major problem that arises in this regard is that in the case of agency employment, there is great risk in terms of relief available in case of injury to the workers or to third party workers. (Johnstone Quinlan, 2005)What happens in such cases; is that the agency which hires the workers claims that the workers were working under the directions of the host employer or the principal employer. On the other hand, the principal employer claims that the agency has hired the workers and as such it should be held liable for the injury caused to the third party or the workers of the agency which has provided the workers. This creates confusion and provides a scope for legal manipulation thereby denying or at least delaying grant of relief to the aggrieved which is a reason for concern because despite government attention on the matter for a very long time now, there have not been too many legislative efforts to regulate the area. On the other hand in cases of temporary transfer of business, the whole job is outsourced and along with it the responsibility to compensate is also transferred. Wilde believes that the artist should not portray any of himself in his work, so when Basil does this, it is he who creates his own downfall, not Dorian. Wilde introduces Basil to Dorian when Basil begins to notice Dorian staring at him at a party. Basil suddenly became conscious that someone was looking at . turned halfway around and saw Dorian Gray for the first time Wilde 24. Basil immediately notices him, however Basil is afraid to talk to him. His reason for this is that he does not want any external influence in life Wilde 24. This is almost a paradox in that it is eventually his own internal influence that destroys him. Wilde does this many times throughout the book. He loved using paradoxes and that is why Lord Henry, the character most similar to Wilde, is quoted as being called Price Paradox. Although Dorian and Basil end up hating each other, they do enjoy meeting each other for the first time. Basil finds something different about Dorian. He sees him in a different way than he sees other men. Dorian is not only beautiful to Basil, but he is also gentle and kind. This is when Basil falls in love with him and begins to pai nt the picture. Basil begins painting the picture, but does not tell anyone about it, including Dorian, because he knows that there is too much of himself in it. Lord Henry discovers the painting and asks Basil why he will not display it. Lord Henry thinks that it is so beautiful it should be displayed in a museum. Basil argues that the reason he will not display the painting is because he is afraid that has shown in it the secret of his soul Wilde 23. This is another paradox because he has not only shown the secret of his soul, but the painting eventually comes to show the secret of Dorians soul also. In the preface to The Picture of Dorian Gray, Wilde explains that to reveal art and conceal the artist is arts aim Wilde 17. Basil realizes that he has not concealed himself in the painting and therefore feels the painting is not worth anything. After Lord Henry sees the painting, he asks to meet Dorian. Basil says that would not be good because his influence would be bad Wilde 31. Basil is correct in saying this because Lord Henry is the main person who helps Dorian to destroy himself. Lord Henry disregards Basils request and meets Dorian anyway. This is the beginning of the end for both Dorian and Basil because Lord Henrys influence pollutes Dorian. Lord Henry taunts Dorian and continues to remind him of all the sin that is building up  and that even though his body is not aging, his soul is deteriorating fast. When Basil notices that Dorian has not changed physically in many years, he is curious to know how Dorian stayed beautiful, but also wants to know why Dorian has changed so much emotionally. Basil does not have the painting on display, but rather keeps it in the attic. When Dorian comes over one day, he and Basil are talking when Basil asks, I wonder do I know you? Before I could answer that, I should have to see your soul. Wilde 216 Dorian goes into a rage and takes Basil upstairs to see his soul which is concealed in the painting. When Basil sees the painting which is bloody and atrocious looking, he cannot believe that he painted it. Dorian reassures him that it is indeed Basils painting. In that painting is all of Dorians hate, fear, and sadness reduced onto a canvass. READ: The Tempest Epilogue AnalysisWhen Dorian sees the picture, he blames Basil for it and picks up a knife laying on a nearby table and stabs Basil. He then takes the knife and stabs the painting in the heart, killing his soul, and returning the painting to its original form. Wilde constructs this in an interesting way because after Dorian stabs the picture, which is a representation of his soul, Wilde shows Dorian laying on the ground, wrinkled and disgusting, with a knife in his heart. Wilde did this to show that when Dorian stabbed the painting, he was actually stabbing himself. Oscar Wilde first portrays Dorian Gray as a sweet, sensitive man whom everyone admires. When Basil, however, began admiring Dorian, he changed. Lord Henry moved into his life, and the painting showed a form of beauty that he could never be able to achieve again in real life without the help of magic. With this, Dorian conceals his morbid soul with the painting and continues living as beautiful as he ever was, physically, but spiritually he is rotting inside. Wilde creates an animal out of the seemingly perfect man and has him destroy himself and his friends along with him. All of this happened because of the picture of Dorian Gray.

When responding to a situation, who has the right to justify whether the action was morally right? Is justification dependant upon love, motive, intention or belief? Where does love factor into a situation? If love is the determining factor behind a lie, is it therefore justified? Situation ethicists would say that love decides which actions are morally right. The circumstances of which an act is executed, decides upon the moral justification. Responsibility appears to widen as the choice of outcome increases. By telling a lie, you therefore have to accept full responsibility for its consequences. Will this widening of freedoms be a problem in a society where we are all of different moral standing? The truth of the matter is that maybe there may be some people within society who do not conform to the same moral standards set down by their community. When making important moral decisions (some may classify lying as one such example), is it not important to be fully qualified? Some may argue that those who are morally uneducated are not competent of making important decisions, and therefore this widening freedom, is potentially a road to moral disaster. Lies are justifiable, as conception of morality and social ethics are distorted. Perception of truth is also an underlying factor for discussion. The ability to rationalise situations depends upon intellect and up-bringing. Most situations can be rationalised as morally right, (if youre of the belief of subjectivism everyone has the right to their own moral beliefs), as long as a person is of a high enough intellect. Lying can equally be justified by those who are of low and of high intellect, as a full understanding and comprehension of the consequences and detriment of certain actions is understood on different levels. Those who have greater understanding may therefore see the lie as morally wrong. This would be due to the fact that they have a different insight into the situation. Different people have different views upon moral attitudes, and most believe theyre more than entitled to their opinion. Cultures will rationalise situations with different theories and attitudes, and as a result of this, lying in one culture can be morally right, whereas in another it will be morally wrong. Society will nurture people into certain beliefs and understandings, and consequently the moral justification surrounding lies will always differ from society to society. (B) Living in the modern world, we are lead to believe that social tolerance is a norm. It would be nice for this to be the reality; however, we all know it is an unachievable dream. The subjectivist creates a lifestyle which everyone aspires to but society denies us of. The idea that you have the ability to think, understand and believe whatever you would like to, would be nice, the practicality of it unfortunately, is that this type of thinking would only bring about conflict within humanity. No level-ground would exist. With everyone of the opinion that they were right, would we not be on our way to creating an argumentative generation who are not capable of compromise? The theory is good, but the practise should never be tried if we want our world to stay relatively civilised. If society should be made to conform, then why are we not living in a land where our lives are shaped by rules and regulations? Absolutists would relish the day that humans are made to toe the line. Conflict and difference within the world, would not occur as everyone would be living within the same rules, and therefore there would be no room for discrepancies. The diversity between societies creates an environment in which tolerance is needed to overcome conflict. By establishing a theory which allows a plural approach to situations, it can be understood that we are encouraging a greater respect and appreciation of the differences between cultures. This conventionalist approach rejects ethnocentricity, but accepts, like subjectivism, certain ideas like Hitlers genocide. How can an approach such as this be received as acceptable within the civilised world? Other controversial questions are raised by this point of view, e.g. How can we remain neutral in response to situations which one culture accepts to be morally right, and another deems morally wrong? This question would never arise if an absolutist approach was imposed upon the world. The principle that there is one set of moral truths to be followed by everyone, independent of religion or culture, can also be believed to be the will of God. His omnipotence means that his law is the only law. The other philosophy is that of Jesus claim, that love is the greatest charge, and therefore there is leeway, as far as love is the driving factor. On the reverse, situation ethics would argue, that ethical rules are very often minor; the individual situation should be individually evaluated. Maybe love is the greatest factor, but this is highly disputed between the theorists. The love theory: Im sure many people would like to believe that if the motive, intention or even the outcome is love, then lying is morally acceptable, but for many the truth may not be so clear cut. Once again, the idea is good in theory, but the practice may not be so realistic. Telling the absolute truth to everyone you meet seems like an ideal way to live; never having to cover up lies with more lies. Minimally distorting the truth, (white lies), is an excepted custom these days. Lying is an accepted way of life for two fundamental reasons: 1. To provide gain and 2. To avoid pain. However, the problem facing people today is the fact that lies are easily exposed by our body language, and most peoples natural feeling of guilt. So, are we really gaining or avoiding anything, if the truth is bound to surface sooner or later? The birds in this experiment live on the island and survival is not easy and it is baking hot during the day, freezing cold at night and there isn’t much food available. Because of this, the birds have very specialized feeding behaviors. An example of evolution resulting from natural selection was discovered among birds living in the Galapagos Island.These birds have varieties that vary in what they eat and their appearance. The specialization developed allowed the birds to survive during the dry season or times of drought/low precipitation when little food is available. Then this specialized tool allows the birds to better compete for food resources with other birds and animals. The objective of this experiment is to differentiate and determin e what happen when the parameters are changed over time between the Darwin and Wallace report. The first experiment is meant to study the influence of beak size on the birds’ population numbers.Deep breaks are suited to crack hard seeds, and shallow beaks are better suited for cracking soft seeds. To test out the hypothesis, I was able to change the beak size of Darwin to 17. 0mm and let Wallace Island at 12. 0mm. Emily the Criminal Mastermind Essay

In the story A Rose for Emily, Emily murders her lover  using poison. The readers are led on to think that she kills him  because she does not want him to leave her, which is what he intends  to do. Her relationship with Homer Barron, her lover, is a normal  relationship; nothing indicates that their relationship is in any kind  of trouble. Having examined her relationship and characters, Emily  can be seen as a master criminal. As opposite as they are of each other, they are attracted to one  another. Although the relationship between Emily and her father is  dysfunctional, her relationship between her and Homer is a healthy  one. Homer works with a construction company, and he is in the  leadership position in his workplace. He can be seen as a joker as he  makes everyone laugh wherever he goes. He is a popular person because  he makes himself well known to everyone in town. Wherever he goes,  little boys would follow him to hear him talk and tell jokes. She, on  the other hand, is always quiet. She doesn’t talk to anyone in town. There are gossips of her but she would never confront them; instead,  she just ignores them. As opposite as Emily’s personalities are to  that of Homer’s, they get along with each other. This shows that she  can be sociable. After all, she can get along with the most popular  guy in town.  She is very calm, cool and collective. After her father  dies, some people visit her to offer sympathy, yet she is â€Å"dressed as  usual with no trace of grief on her face.† Even though she has killed  Homer, when the people in the town visit her because she doesn’t pay  her property tax, she speaks to them as though there isn’t anything  wrong. When she goes to buy the poison to kill Homer, she speaks with  certainty that she wants to buy the poison. â€Å"I want arsenic,† she  says. This indicates that she has contemplated to kill Homer. When  the druggist insists that she tells him what she is going to use it  for, she silen ces him with her look. She knows what she is doing. She can be seen as controlling and manipulative by the  silence of the Negro, her house keeper. The Negro goes out to the  store every now and then to buy food from the market, he doesn’t talk  to anyone. Though the author does not indicate whether the Negro  knows about Homer’s dead corpse in the bedroom, it’s hard to imagine  that he doesn’t know about it. The neighbors complain of the smell,  which they do not know that it’s from a dead body. For the duration  that the body has been in the house, it’s impossible to imagine that  the Negro has no knowledge of it. Assuming that he knows, yet he  doesn’t talk to anyone about it shows that she has control over him. Ruling out that she’s suffering from insanity, one can  only conclude that she’s criminal mastermind. Even though her father  is abusive, she is able to have meaningful relationship. Her  relationship with Homer shows that she can be sociable. After her  father’s death, she shows no grief. While having Homer’s body in the  bedroom upstairs, she attends to her guests as though nothing is  wrong. At the same time, she is able to keep the butler from talking  to anyone about anything. Planning to kill Homer, she buys the poison  without any hesitation even though the druggist asks her many  questions. Using the control that she has over the person under her  and her environment, she gets away with murder.

It was a decade of change, one of freedom, a time for great music. It was also an incredible decade for shock, fear and serial killers. John Wayne Gacy, an amateur clown, was a pedophiliac homosexual. He tortured and killed thirty three little boys and stored their remains under his house. David Berkowitz, a.k.a. the Son of Sam, stalked New York City from nineteen-sixty-seven to nineteen-seventy-seven. He claimed to have been following a voice from his dog that told him when and where to kill. Ted Bundy, who is believed to have killed at least thirty-four people, was charged for only three under his own defense- and in fact, he was commended by the judge for his own defense. He was put to death. With the combination of a very powerful media and a society fascinated with gruesome, sadistic crimes, modern serial killers have been put in the spotlight. We are enraptured with serial killers so much, that we pay seven dollars to go see a movie where everyone except the bad guys gets strangled, mutilated, or shot- and enjoy it in some sick way. The media goes out of its way to glamorize murder and terrify the public. We support killers like Charles Manson on Death Row with our tax dollars. In fact, we support them with more than that. About two months ago there was an art show in California entitled: The Death Row Art Show III. Pieces sold for thousands of dollars regardless of their aesthetic appeal, because of the identity of the artists. Serial killers are becoming as popular as rock stars. Serial killers are a development of the industrial world; they really didn't "come about" until the late eighteen-hundreds when society was becoming modernized and the threat of the new age sort of displaced some individuals so much they felt they had to kill to get their point across to society. Jack the Ripper is probably the most notorious killer in history because he established the serial killer profile. Ripper set up a pattern for the new line of mass murderers who would follow in the tradition of a truly organized killer. He had a sexual obsession with prostitutes that led him to target complete strangers for a days work. When he was done, he laid his victim out in a ritualistic manner with various disemboweled items placed strategically on or around the victim's corpse. Of course, murder has been around for centuries, committed by under-educated thieves. No one was interested in meeting, and hearing about a poor peasant that slit someones throat in a dark alley. But ever since the introduction of serial killers into our society, with their precision and strategy of the murder, the media became fascinated with these people, and so did society. So instead of killing or punishing these horrible people, we now have television networks arguing over movie rights to the killers story. News shows fighting to get the "exclusive interview". T-shirts with the killers faces on them(e.g.. the famous "Manson T-shirt"). The only explanation I can offer is that we are still obsessed with our own mortality, and we always will be. As long as we die, we'll be fascinated by those who seem to be invincible from death like, serial killers, Hitler...its almost as is we like to see the act of death itself, over and over, to observe the exact moment- or what it is that puts us over that incredible brink between life and death. I can honestly say I am fascinated with the serial killer. But since when did we condone the practice of serial killers? Why aren't they put to death promptly after being convicted, instead of being kept alive for the media to interview? You have to wonder who is making money in this. When we allow people like this to dominate our media, it's like we're saying its all right to murder. Did society and the media forget that the victims of those serial killers are us and our families?
